Certain real estate brokerage activities may be performed by a licensed Texas real estate agent through the agent’s sponsoring real estate broker. Real estate brokerage services are separate from any property-improvement, contractor-referral, marketing, consulting, lead-generation, or coordination services offered by PropertyOps Group or its affiliates.

Nothing on the Website creates a brokerage relationship, representation agreement, contractor relationship, fiduciary relationship, or other professional relationship unless that relationship is established through a separate written agreement when required.

3. Website Information

Information provided on the Website is for general informational and educational purposes.

PropertyOps Group makes reasonable efforts to provide useful and accurate information but does not guarantee that information on the Website is complete, current, or error-free.

Real estate markets, property values, interest rates, taxes, insurance costs, construction costs, contractor pricing, availability, and other property-related information can change frequently.

You should independently verify information that is important to a financial, real estate, construction, investment, or other significant decision.

4. Real Estate Services

Real estate brokerage services are subject to applicable Texas law, regulations, brokerage policies, and separate agreements between the applicable parties.

Use of the Website, communication with PropertyOps Group, submission of a form, receipt of a property analysis, or participation in a consultation does not by itself establish an agency or brokerage relationship.

Any required representation agreement, listing agreement, buyer-representation agreement, disclosure, or other real estate document will be handled separately as required by applicable law.

PropertyOps Group does not guarantee that a property will sell, that a buyer will purchase a property, that a particular price will be obtained, or that a transaction will close.

5. Property Values, Market Analyses, and Estimates

Property values, comparative market analyses, estimated sales prices, estimated proceeds, renovation estimates, return-on-investment estimates, and similar calculations are estimates only.

Actual results may differ because of market conditions, property condition, inspections, appraisals, financing, negotiations, buyer demand, repair requirements, closing costs, taxes, insurance, and other factors.

Unless specifically stated otherwise in a separate written agreement, information provided through the Website is not an appraisal and should not be relied upon as a substitute for an appraisal or other professional valuation.

6. Website Calculators

PropertyOps Group may provide calculators for mortgages, affordability, estimated seller proceeds, closing costs, property improvements, investment returns, or other property-related purposes.

Calculator results are estimates provided for informational purposes only. Inputs, assumptions, interest rates, taxes, insurance amounts, commissions, closing costs, financing costs, appreciation assumptions, improvement values, and other variables may differ from actual amounts.

Calculator results do not constitute financial, lending, tax, legal, investment, appraisal, or accounting advice and do not guarantee any particular financial or transaction result.

7. Property Improvement and Contractor Services

PropertyOps Group may provide information concerning property improvements and may help homeowners identify, communicate with, obtain estimates from, or coordinate with independent contractors and service providers.

Unless expressly stated otherwise in a separate written agreement, contractors and service providers are independent businesses and are not employees of PropertyOps Group.

Contractors and service providers are responsible for their own estimates, contracts, licenses, insurance, permits, employees, subcontractors, scheduling, workmanship, warranties, safety practices, materials, and performance.

Homeowners are responsible for reviewing and approving contractors, estimates, contracts, scopes of work, pricing, insurance, licenses, warranties, and other terms before hiring a service provider.

PropertyOps Group does not guarantee the availability, pricing, performance, workmanship, licensing status, insurance status, or results of any independent contractor or service provider.

8. Contractor Referrals and Compensation

PropertyOps Group may receive compensation in connection with referrals, marketing services, lead generation, consulting, coordination, or other services provided to contractors or service providers.

Such compensation may be paid by a contractor or service provider and may be based on a lead, referral, project, marketing arrangement, consulting arrangement, or other agreed compensation structure.

Where disclosure of a compensation arrangement is required by applicable law, PropertyOps Group will provide the required disclosure.

Users are free to choose whether to contact, hire, or work with any contractor or service provider presented to them.

9. No Guarantee of Results

PropertyOps Group does not guarantee any specific outcome from the use of the Website or its services.

This includes any guarantee regarding:

* Property sale prices or time on market;

* Property appreciation or investment returns;

* Financing approval or lending terms;

* Cost savings from property improvements;

* Increased property value resulting from improvements;

* Contractor pricing, availability, scheduling, or performance; or

* Successful completion of any real estate, contractor, or property-improvement transaction.

Past results do not guarantee future results.

10. User Information

When you submit information through the Website, you agree to provide information that is accurate to the best of your knowledge.

11. PropertyOps Group SMS Messaging Program

Program description

The PropertyOps Group SMS Messaging Program allows eligible consumers who affirmatively opt in to receive text messages from PropertyOps Group, LLC.

Depending on the consent provided and the consumer’s relationship with PropertyOps Group, messages may include:

* Responses to website inquiries;

* Requested information about buying or selling real estate;

* Property-consultation communications;

* Appointment scheduling, confirmations, and reminders;

* Property-analysis and service follow-ups;

* Real estate transaction or service updates;

* Information concerning property improvements or home services;

* Responses to contractor or property-service inquiries;

* Customer-care communications;

* Reminders and other communications related to services requested by the recipient; and

* Marketing or promotional messages when the recipient has separately consented to receive those messages.

Transactional or non-marketing consent does not automatically constitute consent to receive marketing or promotional text messages.

How users provide consent

Users may opt in through a PropertyOps Group website form or another consent method clearly presented by PropertyOps Group.

Website forms containing SMS consent use a separate checkbox that the user must affirmatively select. SMS consent checkboxes are not selected automatically.

Submitting a telephone number without selecting an applicable SMS-consent checkbox does not, by itself, constitute consent to receive automated marketing text messages.

Voluntary consent

Consent to receive text messages, including marketing or promotional messages, is not a condition of purchasing any property, goods, or services.

Message frequency

Message frequency varies depending on the recipient’s inquiry, requested services, appointments, transaction activity, and communication preferences.

Message and data rates

Message and data rates may apply. Your wireless provider’s message, data, and other rates may apply to messages sent or received as part of the SMS program.

Opting out

You may opt out of text messages at any time by replying **STOP** to any message from PropertyOps Group.

After you reply STOP, you may receive one final confirmation message stating that you have been unsubscribed. After that confirmation, PropertyOps Group will not send additional text messages covered by that opt-out unless you subsequently provide new consent or otherwise request that messaging resume.

You may also use other supported opt-out keywords, including CANCEL, END, QUIT, or UNSUBSCRIBE. However, replying STOP is the recommended method.

Carrier liability disclaimer

Wireless carriers are not liable for delayed or undelivered messages.

Message delivery is subject to effective transmission by your wireless carrier and is not guaranteed by PropertyOps Group.

Availability of text-messaging services may depend on your mobile device, wireless carrier, service plan, location, and network availability.

Participating carriers

The SMS program may be available through participating United States wireless carriers. Carrier participation and supported features may change without notice.

Privacy and mobile information

Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. Text-messaging originator opt-in data and consent will not be shared with third parties, except service providers that facilitate the delivery of text messages.

12. Email and Telephone Communications

If you provide your email address or telephone number, PropertyOps Group may contact you regarding your inquiry, requested services, appointment, property-related information, or other communications for which you have provided permission.

Marketing emails will include an appropriate method for unsubscribing. Unsubscribing from marketing emails may not prevent transactional or service-related emails necessary to respond to an existing request or provide an agreed service.

Telephone calls and text messages will be made in accordance with applicable law and the consent provided by the recipient.

13. Third-Party Services and Websites

The Website may contain links to or integrations with third-party websites, real estate platforms, lenders, contractors, service providers, software providers, or other third parties.

PropertyOps Group does not control and is not responsible for third-party websites, services, privacy practices, content, availability, or performance.

PropertyOps Group is not responsible for losses resulting from reliance on Website estimates, calculators, third-party information, contractor estimates, market information, or other informational content.

Nothing in these Terms limits liability that cannot legally be limited under applicable law.

18. Professional Advice Disclaimer

Information provided through the Website does not constitute legal, tax, accounting, engineering, inspection, lending, insurance, investment, or other professional advice unless expressly provided by an appropriately licensed professional acting in that capacity.
